Introduction
For the purposes of this Agreement, Lednor Corporation dba Lednor Home Solutions, located at 210 Najoles Rd, Millersville, MD 21108, will be referred to as the “Contractor,” and the property owner as the “Owner” (collectively, the “Parties”). The Contractor agrees to provide all materials and labor required to perform the work listed in the signed Agreement unless otherwise stated.
Agreement Validation
This offer by the Contractor for service(s) is valid for fifteen (15) days from the date listed on your Agreement. Your Agreement becomes valid only once:
- It is signed (in writing or electronically) by the Owner or an authorized designate of the Owner.
- It is received by the Contractor along with any required deposit.
Peace of Mind Guarantee
Lednor Home Solutions prides itself on providing “peace of mind” service(s) for everything we do. Upon completion of the service(s) listed in your Agreement, we will notify you via email or text message. If you do not receive a notification, rest assured that our service technicians log every service, and our techs are GPS-tracked via their company issued mobile device. You can also call us toll-free at 888-543-5638, Monday – Friday, 8 AM – 4 PM, to confirm service completion.
Insurance
The Contractor is fully insured with both liability and workers’ compensation insurance. This insurance protects against claims for property damage and bodily injury related to the work specified in the signed Agreement.
Gutter Cleaning Service
The Contractor will clean the gutters at your property, removing debris such as leaves, twigs, and other foreign objects. Only above-ground downspouts will be cleaned. Various methods may be used, including ladders with standoffs, harnesses, water hoses, blowers, automated brushes, and manual hand cleaning. The Owner grants permission to use water, faucets, and hoses as necessary. If compacted debris cannot be removed during normal cleaning, downspouts may need to be disassembled (see additional services below).
- Gutter Debris: The Contractor will make every effort to maintain your property in its initial condition. Debris will be removed, but roof debris will remain where it falls unless otherwise specified (see additional optional services below).
- Underground Drains: Our agreement does not include cleaning and testing of underground drains unless otherwise specified. The Contractor will clean downspouts to the ground level only.
- Gutter Screens/Covers: The Contractor may remove and dispose of gutter screens or covers during the first cleaning unless otherwise noted. If the Owner wants screens/covers replaced after each cleaning, this must be included in the Agreement. The Contractor is not responsible for any damage to screens/covers during cleaning or replacement.
Scheduling
Cleanings are scheduled by ZIP code and are subject to weather conditions. The Contractor reserves the right to adjust the cleaning schedule. Owners must request schedule changes at least two (2) weeks prior to the scheduled month. Changes cannot delay service by more than one month from the original date. Requests must be made in writing via email or text.
Access & Service Refusal
The Owner must ensure full access to the property. If access is denied, a $50.00 trip charge will apply. If service is partially completed and then access is denied, the full-service cost plus an additional trip charge will apply if a return visit is needed.
30-Day Gutter Cleaning Guarantee
If unsatisfied, the Owner must notify the Contractor within thirty (30) days for a re-cleaning. A $50.00 re-clean fee applies if new debris is found or if the notification period is exceeded. The Contractor is not responsible for damage due to faulty, old, or damaged gutter systems but can make recommendations on additional services necessary to bring your system up to good working order.
Repair & Installation Services
Scheduling and delays are as previously described. A $50.00 trip charge applies if access is denied.
- Standard Limited Warranty (Gutter and Downspout Installations): The Contractor warrants workmanship for up to one (1) year. Our standard gutter installation warranty includes a 20-year material and 5-year leak warranty. This warranty is voided if the system is tampered with by others or the Owner.
- Unforeseen Circumstances: Additional charges may apply for unforeseen issues, which will require a separate Agreement.
- Yard Sign: A small yard sign will be placed in the Owner’s yard during and up to two weeks after work completion.
Unforeseen Circumstances
If the Contractor begins repair or installation service and discovers that the service cannot continue due to unforeseen circumstances—such as rotted wood, roofing problems, or other factors that could not have been reasonably foreseen at the time of preparing the Agreement—a separate Change Order Agreement detailing any additional charges will be provided. This Agreement must be signed by the Owner before the Contractor proceeds with the service.
Additional Services/Changes
Additional services or changes must be documented and signed by both Parties via a Change Order document that the Contractor will send to the Owner.
Delays
The Contractor will not be held responsible for any delays resulting from acts of nature, fire, flood, weather (including but not limited to rain, snow/ice, or sub-freezing temperatures), or any other unavoidable casualties; labor strikes; late delivery of materials; neglect by the Owner; or any other cause beyond the Contractor’s control.
Cancellations & Refunds
The Owner may cancel at any time prior to the commencement of the first service(s) listed in your Agreement. Once the service has begun, the Contractor reserves the right to complete all work listed in your Agreement. For Installation Services (Gutter and Downspout Installations ) the Owner has THE RIGHT TO CANCEL THIS AGREEMENT WITHIN FIVE BUSINESS DAYS AFTER
THE DATE YOU SIGN AND SEVEN IF YOU ARE AT LEAST 65 YEARS OLD BY NOTIFYING THE CONTRACTOR IN WRITING THAT YOU ARE CANCELING THE AGREEMENT. Cancellations must be made in writing via email to the address noted at the bottom of these terms and conditions. The Contractor reserves the right to cancel your Agreement at any time. Upon cancellation before the commencement of work, the Contractor will refund the Owner any outstanding pre-paid balance or deposit. Once work has commenced, the Owner agrees to pay the Contractor as follows:
- Gutter Cleaning Service(s): The Owner will pay for any cleaning service(s) that have been completed, as well as 25% of the remaining balance of your service Agreement.
- Installation Service(s): The Owner will pay for all materials and work commenced by the Contractor prior to any cancellation.
Payment Terms
Payments are due in full upon service or instillation/repair completion. Late payments will incur a $25.00 fee plus interest. This agreement may create a lien against your property to secure payment and may cause a loss of your property if you fail to pay the agreed amount.
Limitation of Liability
In no event shall the Contractor be liable for any indirect, incidental, special, exemplary, or consequential damages of any kind, arising from or relating to any claim at law or in equity. The Contractor’s total aggregate liability to the Owner or any other person or entity for all claims, damages, losses, costs, and causes of action arising out of or relating to this Agreement and/or the Contractor’s provision of service(s) to the Owner shall not exceed the total amount paid by the Owner to the Contractor in the six (6) months immediately preceding the date on which the act or omission occurred that gave rise to the claims, damages, losses, costs, or causes of action.
Miscellaneous
All rights and remedies set forth in your Agreement are cumulative with all other rights and remedies available to the Contractor at law or in equity. Your Agreement may not be assigned by the Owner. This Agreement constitutes the entire agreement of the Parties with respect to the matters contained herein and shall be binding upon the Parties and their permitted assigns. Titles and headings in your Agreement are provided for clarity and convenience; they are not to be construed as creating legal obligations in and of themselves. If any provision of your Agreement is held to be illegal, unenforceable, or in conflict with any law of a federal, state, or local government having jurisdiction over your Agreement, the validity of the remaining portions or provisions hereof will not be affected. The exclusive jurisdiction and venue for any disputes arising out of your Agreement shall be the state Circuit and District courts located in Anne Arundel County, Maryland, and all Parties hereby consent to personal jurisdiction and venue therein.
